These terms set out the rules for using hikesoul.com and buying from Hikesoul. Please read them before placing an order.

1. Agreement to these terms

These Terms of Service govern your use of hikesoul.com and any purchase you make through it. By browsing or ordering from this website you agree to these terms. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm that the payment method used belongs to you or that you are authorized to use it.

3. Store conditions

We may refuse service, cancel an order, or limit quantities at our discretion. We may also change or discontinue any product at any time without notice. Hikesoul sells to end consumers only; orders placed for resale may be cancelled.

4. Product information and accuracy

We describe our products as accurately as we can. Colours may appear differently on different screens, and dimensions, weights and capacities are approximate and supplied by the manufacturer. Product images are illustrative; accessories shown are not included unless listed in the description.

5. Fitness for purpose and outdoor use

Products sold by Hikesoul are consumer outdoor equipment. They are not certified safety equipment, life-saving equipment or technical climbing gear, and must not be relied upon as such. See our Disclaimer for the full statement.

6. Pricing and errors

All prices are in USD (US Dollars) and are subject to change without notice. Despite our efforts, listings may occasionally contain errors in price, description or availability. We reserve the right to correct such errors and to cancel any order placed on incorrect information, with a full refund.

7. Orders and payment

Your order is an offer to buy. A contract is formed when we dispatch the goods. Payment terms are set out in our Payment Policy.

8. Shipping and returns

Delivery timeframes and carrier terms are set out in our Shipping Policy. Your right to return an item and how refunds are handled are set out in our Return & Refund Policy. Both form part of these terms.

9. Accounts

If you create an account you are responsible for keeping your password confidential and for activity that takes place under it. Tell us promptly if you believe your account has been used without your permission.

10. Third-party tools and links

This site uses third-party services for payment, tracking, analytics and email. It may also link to external websites. We do not control third-party sites and are not responsible for their content, products or privacy practices.

11. User contributions

If you submit reviews, comments, images or other content, you grant us a non-exclusive, royalty-free licence to use it in connection with the store. You are responsible for content you submit, and we may remove content that is unlawful, misleading or offensive.

12. Prohibited uses

• Using the site for any unlawful purpose or to solicit unlawful acts.
• Infringing our intellectual property or that of others.
• Uploading viruses or any code designed to affect the site's operation.
• Scraping, harvesting or automated collection of site data.
• Attempting to gain unauthorized access to any part of the site.
• Submitting false or misleading information.

13. Intellectual property

The Hikesoul name, logo, site design, written content and photography are our property or used under licence, and may not be copied or reproduced without written permission.

14. Disclaimer of warranties

The site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, except those that cannot be excluded under applicable law. Nothing in these terms limits your statutory rights as a consumer.

15. Limitation of liability

To the extent permitted by law, Hikesoul is not liable for indirect, incidental or consequential losses arising from your use of the site or of products purchased through it. Where liability cannot be excluded, it is limited to the amount you paid for the item concerned.

16. Indemnification

You agree to indemnify Hikesoul against claims arising from your breach of these terms or your misuse of the site.

17. Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in force.

18. Termination

We may suspend or terminate access to the site for any breach of these terms. Obligations incurred before termination survive it.

19. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law rules. Disputes will be handled in the courts of Massachusetts.

20. Changes to these terms

We may update these terms at any time. The revision date at the top of the page shows when they were last changed, and continued use of the site after a change constitutes acceptance.
